Well, I sort of got an offer today. I am going to be graduating in December with a Bachelor's in MIS and today I got a call about an interview. The position is for a Junior Software Engineer at a company in Virginia. It is a contract position that includes paid training and then the company places you with one of their clients on a temporary basis for 3-6 months with a possible extension. The issue I am having is that the company wants to have me sign an what they call a PRE –INTERVIEW / NDA -PARTNER SUBCONTRACTOR contract. They are going to offer me $30/hr on a corp to corp or 1099. Any thoughts?

Ask them to hire you on W2, say $25/hr.

Its just too easy to get ripped off as C to C or 1099, especially as you are inexperienced.

Dude: just jump on the boat. get 3 or 4 months of experience and then either bargain more or go else where. the market is bad at the moment specially if you are new

mrb835 - congrats on the job offer!

The only thing that strikes me the wrong way is that they don't want to offer you a contract on W2. The key point here is that when you are a W2 employee **only**, you will be able to go on unemployment after your contract ends.

Maybe you can ask them if they can make you a W2. If they push back and say "no", take the offer anyway. Either way you slice it, you are very lucky.

I have noticed recently that many staffing companies are shying away from W2 contracts. I haven't asked, but I suspect that the reason may be concern that there may soon be a mandate for them to provide health insurance for employees if they are big enough to have more than 500K in annual revenue.

I think there is an employer mandate in the Health Bill the House of Reps passed last Saturday.

Just to be sure you're clear, that an interview is not an offer.

The NDA should not be a problem - read it, of course, but I think likely the only thing they want to keep secret is their customer list. If it includes language like, "I will not approach your customers for work even if you never hire me", you SHOULD refuse to sign ... as hard as that would be for someone in your position, even if it's very unlikely you would ever want to do that anyway. In California anything like that is completely unenforceable, btw.

It's sad to see a new grad needing to work on a 1099 basis no matter what the rate, but in this economy, I suppose one has to take even such opportunities.

Ace the interview, and good luck with whatever happens next.

Ditto. Get your foot in the door and get some experience and then either negotiate for more money (when things get better) or just move on.

In IT, experience is a critical component to every position.
